KathyJean.net is my business website, which primarily promotes my modeling talent. I work full-time, and am independent of modeling agencies and other types of employment agencies. I am interested in (very select) non-exclusive modeling and/or talent contracts. In keeping with professional industry standards and practices, I have a business policy.

I am working toward talent union eligibility.

I am a legal adult, free to negotiate and enter into legal contracts on my own behalf. Of course, one copy of everything I sign is required for proper business record and bookkeeping. I personally read and reply to the growing volume of electronic and postal mail.

When agencies book a job, usually no cancellation contract is signed. They used to publish headsheet books that stated booking policies, and provided constructive notice to clients that any booking incorporated those terms unless explicitly agreed otherwise. If a client cancelled, the terms were enforced and the client paid. Agencies may have their booking terms on their websites as I do here on mine, which serves the same purpose. Policies may be in "client only" areas, and not visible to the general public. Some agencies do not publish the policies at all. Any client who deals with them is assumed to be a member of the industry and familiar with its norms, so publication is not required. You book from them, you pay a cancellation fee.

Freelance talent should not assume that all of the people they book with will be familiar with such norms so they have to be expressed explicitly; it doesn't have to be as formal as a signed contract. When I accept bookings (whether for money alone or with other compensation) I expect clients to read this page because it lists all the conditions appropriate to that booking, and then confirm that they have read and accept it. Those conditions are then binding.

Weather Permit: Must be stated at the time of the booking. Type of weather must be specified. Cancellation prior to booking day is at no charge, provided it is rebooked at the time of cancellation. Same-day cancellation is half fee, if it is rebooked at the time of cancellation; otherwise, regular cancellation rates apply.

Cancellations: More than one full work day in advance, no fee. Less than one full work day and rescheduled, half fee - not rescheduled, full fee, at location, full fee.

Tentative Bookings: Clients holding tentative bookings have the right of first refusal.

Travel Time: Travel time to locations which are outside the 50-mile radius of Pekin, Illinois will be billed at the full hourly rate unless otherwise negotiated. Travel expenses for jobs outside the 50-mile radius of Pekin, Illinois must be paid by the client, not paid by me and submitted for approval and possible reimbursement at a later date. The current standard mileage rate for business travel is fifty-five cents ($ .55 US) per mile. Travel time and rate are discussed and confirmed beforehand.

I bear sole responsibility for ensuring that my gear and I am transported safely to and from my bookings. My drivers also remove all of my gear from the vehicle and return it immediately following the shoot. This eliminates the chance of my being injured and frees me to focus my undivided attention and high energy on the thoroughly maintained looks and continuously honed talents that I am booked and paid for. Though organized and self-reliant, these people's work is invaluable to me. These people are in the working capacity of my driver and escort and I respectfully reserve the right to be accompanied by one when necessary. They will not be present in the area in which we are working since they are not photographer assistants or other shoot crew members; likewise, they're not errand runners, television viewers, book readers, or other Green Room occupants. They enjoy their favorite pastimes on their own time. I respectfully suggest to parties with concerns about thieves and vandals that they would be wise to disassociate themselves from people of that ilk; I refuse to be involved. On a final note, (important in a studio, especially on a closed set) I am there to work for my client and will not tolerate inappropriate and/or illegal behavior from fellow talent or anyone accompanying them.

Fair consideration is given to all reasonable offers of compensation aside from/in addition to monetary such as tearsheet(s) in no less than nationwide publication, travel and lodging outside of what is customarily provided, apparel, and merchandise.

Please, note that in instances where "time for *" (TF*) is the exchange, it is also agreed that if * is not on its way to me within a reasonable period of time from the date modeling services were rendered, my regular full monetary rates will then be in effect and immediately due in lieu of *. A "postmarked no later than" date must be specified in our written agreement(s). Sundays are not counted, nor are any days counted on which there is no United States Postal Service mail pickup/delivery. It is agreed that no images may be used by you for any purpose whatsoever before all fees have been paid in full. This prevents our agreement(s) from being breached, protects your integrity, and preserves my trust in you and belief that our business is being conducted in good faith. Receipts are issued at the time payment is made. No penalty fees whatsoever are applied to balances due.

Rates are for session time only; usage must be negotiated, as explained above. Lingerie type must be specified at the time the booking is made. Private and secure changing facilities must be provided, as well as a closed set. *Certain expenses requiring customary payment: hotel accomodation, airfare, taxicab, meals (vitally important to the assignment and directly linked to the work being executed).

Sole proprietorships are a type of legal structure along with corporations and partnerships. Primary concern of a sole proprietorship is its owner bearing full, legal responsibility and liability for the business and its operations. The owner needs good insurance to protect his or her personal assets. Coverage for a professional model, photographer, artist, etc. ought to include personal injury, especially as it relates to libel, slander, and malicious prosecution. Personal injury is to a person's reputation or feelings. For-profit is the tax status applicable to sole proprietorships. Under such, there only one person who owns the business. All of the income goes to the owner of the business to cover costs (salaries, etc.). For this reason, sole proprietors typically file their business tax returns as part of their personal income tax returns via a 1040 schedule C. An important advantage to operating a sole proprietorship is the ease and inexpense of setting one up. Keep Original Documents - The first year (maybe few) is stressful; expenses and income may be hard to predict. Start-up and ongoing expenses include cost for an additonal phone hookup deposit/monthly bill for the Internet or fax machine, USPS box leasing, equipment (items that will be used for more than one year i.e. computer, fax machine, telephone, mobile phone), computer and office supplies, advertising and promotion costs, insurance/necessary riders, accounting and legal consulting fees, mortgage/rent, utilities, business loan repayment, federal and state taxes, uncollected fees from nonpaying clients. Market research includes determining the amount of money that photographers and clients in different areas can afford, or are already paying. I visit the United States government's Bureau of Labor Statistics to obtain this and other information. Discounts and nonpaying clients (or "uncollectibles") are two examples of financial issues to explore; there exists an obligation to maintain economic stability, which allows me to provide the best service to all of my photographers, artists, and clients that I model for. Clearly defined policies and practices in writing help to keep a business healthy and thriving.

For the Record - Professionals typically lease commercial space in an office building, but there are many of us whose own local markets are virtually nonexistent. Concerning modeling, Chicago is only a secondary one; it is not the print market it one was. The only three major US markets are New York City, Miami, and Los Angeles (in that order). Guess which state I'm relocating to. I earn money from working out-of-town assignments and with clients who happen to travel to my hometown: Peoria. Some pros do work successfully out of their homes and maintain a home office; this is what I chose to do since paying for commercial space isn't worth it in the Midwest. Separating business expenses from household and personal expenses makes perfect record keeping a challenge. It is important to utilize a system for tax filing purposes. Track expenditures in a receipt book. Full and partial are the two types of deductions that apply to my business. Full deductions are completely subtracted, and for items used solely by the business. Partial deductions are for items used by both the household and the business. Time/space percentage is paramount in proper preparation of a tax return.

I am self-employed, and work full-time to develop my business and profit from my serious and honest efforts. Landing worthwhile assignments and successfully completing them is my goal: performance - the "bricks and mortar" I use to build my reputation. Modeling is a highly demanding, wildly exciting, deeply satisfying and rewarding professional industry career choice for me. I am lucky to have been born with the looks that made this choice possible. That's only the beginning.

Models - actively working full-time models - are self-employed: freelancers. Freelance work pays more than regular employment, no matter the field. It carries more responsibilities and costs to be employed by oneself than it does to simply report to work for someone else. Self-employment dictates that I spend at least as much time marketing myself and handling all administrative tasks as I do actually servicing my clients. Regular employment is a steady paycheck (wages/salary, plus commission for some) with benefits for many.

As a strict freelancer, I sincerely appreciate all offers of representation (exclusive/non alike) and management, and welcome non-exclusive contract offers from parties who must, at least, meet current state licensing requirements. All extremely vague and otherwise suspicious requests including those for services that I do not provide are unacknowledged; I am under no obligation of any kind to dignify inappropriate and/or unlawful contact with a response. Each incident is properly documented, copied, and filed for legal reference. Perpetrators proceed at their own risk.

When terms are negotiable, I work in exchange for what is customary: pay, credit, tearsheet or professional quality laser print for my modeling portfolio, finished copy of production, travel, lodging, comp cards, images on CD, and/or other compensation (try me) that is fair and reasonable. This includes round-trip airfare or fuel. I do not request more than what I am worth, and accept no less.

A particular talent's market demand and reputation, nature and length of the shoot, traveling time and expenses*, concurrent requests, edition, circulation, and intended use of images all influence the cost that services rendered by a pro model may reasonably expect to be.

Working as a novice, I charged by the hour. My rate is computed on a half-day (four hours), full day (eight hours), or flat rate basis since turning professional. There exists a vast difference among pay rates which are dependent upon the metropolitan area and season, not to mention market demand for an individual. Specific and exact rates are based on what each particular assignment requires, including any special terms/conditions.

I am uninterested in receiving royalties for the use of my image, and do not negotiate for any being contracted. No retainer fee/deposit is required. There is no fee to enter into a release agreement, a copy of which is due at signing. I do not model nude in exchange for prints or CD alone, but do in exchange for an art exhibition or tearsheet. Modeling is the most basic form of acting. I consider critiques from qualified industry peers and general public reviews of my work to be extremely important feedback and welcome you to submit yours as guestbook messages. Portrayals and role playing in posing for a still photo, acting, any type of dancing, entertaining, doing any voice work or promotional work should not be confused with reality; some people are not intelligent enough to make the distinction or simply prefer to think that professional work and personal life are one and the same.
